These Terms and Conditions ("Terms") govern your use of the services provided by Community Moving Crew ("CMC," "we," "us," or "our"). By hiring us, you ("client," "you," or "your") agree to be bound by these Terms.
1. Services Provided
CMC provides a range of moving services, including but not limited to:
Loading and unloading of moving trucks, pods, and storage units.
Packing and unpacking services.
Disassembly and reassembly of furniture.
In-house furniture rearrangement.
We are a labor-only moving company. We do not provide the moving truck, transportation, or moving supplies (e.g., boxes, tape, packing paper) unless explicitly agreed upon in a separate service contract.
2. Pricing and Payment
Hourly Rate: Our services are billed at an hourly rate, which is based on the number of crew members required for the job. The hourly rate begins when our crew arrives at your location and ends when the job is completed to your satisfaction and all paperwork is finalized.
Minimums: All jobs are subject to a minimum charge, typically [e.g., 2 or 3] hours. If a job is completed in less than the minimum time, you will still be billed for the minimum.
Travel Time: Travel time may be charged for jobs outside our standard service area. This will be communicated and agreed upon in advance.
Payment: Payment is due in full at the time of service completion. We accept [e.g., cash, credit cards, Zelle, Venmo, Cashapp]. A payment method will be requested at the time of booking. A service fee may be applied to credit card transactions.
Deposits: A non-refundable deposit may be required to secure your booking. This will be applied to your final bill.
3. Cancellations and Rescheduling
Cancellations: If you need to cancel your booking, you must do so at least [e.g., 48-72] hours before the scheduled service time. Cancellations made after this period may result in a cancellation fee equal to [e.g., the deposit amount or a one-hour charge].
Rescheduling: We will do our best to accommodate rescheduling requests. Rescheduling requests made with less than [e.g., 48] hours' notice may be subject to a fee.
4. Client Responsibilities
Preparation: You are responsible for ensuring that all items are packed and ready for transport before our arrival, unless you have hired us for packing services. This includes sealing boxes and properly labeling them.
Access: You must ensure clear and safe access to your property and the items to be moved. This includes arranging for parking, reserving elevators, and notifying building management as necessary. Any delays caused by lack of access may result in additional charges.
Hazardous Materials: You are responsible for identifying and moving any hazardous materials, including but not limited to: paints, fuels, chemicals, and pressurized containers. CMC will not handle these items.
Valuables: We recommend that you move all high-value items yourself, including jewelry, cash, important documents, and sentimental heirlooms. CMC is not liable for the loss or damage of these items.
5. Liability and Damage
Limited Liability: CMC is a labor-only company. We are not a transportation company and do not provide insurance for items in transit on a client-owned or rented vehicle.
Damage to Items: Our crew will exercise the utmost care in handling your belongings. In the event of damage caused by our crew's negligence, our liability is limited to [e.g., $0.60 per pound, or a maximum of $50 per item]. This liability applies only to items we physically handle.
Damage to Property: We will take reasonable precautions to protect your property (walls, floors, doors). If damage to your property occurs as a direct result of our crew’s negligence, you must notify the crew lead before they leave the premises. Any claims must be made in writing within [e.g., 7] days of the service date, and our liability is limited to the cost of repair or replacement, up to a maximum of [e.g., $500].
Pre-existing Damage: We are not responsible for pre-existing damage to furniture, appliances, or property. You agree to document and bring any such damage to our attention before the service begins.
Large and Heavy Items: Items weighing more than [e.g., 300] pounds may require additional crew members, special equipment, and/or a signed liability waiver. We reserve the right to decline moving items that we deem unsafe to move.
6. Safety
Safe Working Environment: You agree to provide a safe working environment for our crew. This includes clear pathways, adequate lighting, and a temperature-controlled space.
Injury: CMC is not responsible for any injury sustained by you or anyone else assisting with the move. Our liability is strictly limited to our employees.
Bed Bugs/Pests: If our crew encounters evidence of bed bugs or other pests, we reserve the right to immediately stop the job to prevent the spread of pests to other clients. You will be responsible for the full cost of the service up to that point.
7. Disputes
Any disputes arising from these Terms will be resolved through good-faith negotiation. If a resolution cannot be reached, we agree to binding arbitration in [e.g., your county/state], in accordance with the rules of the American Arbitration Association.
8. General Provisions
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of [Your State].
Entire Agreement: These Terms constitute the entire agreement between you and CMC.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Modification: CMC reserves the right to modify these Terms at any time. The most current version will always be available on our website.
